Terms of Use

TITLE I — GENERAL PROVISIONS
Article 1 — Presentation, purpose and contractual documents
Agostina is an independent fashion mobile marketplace, published by the company Agostina, a single-shareholder simplified joint-stock company (SASU) with a share capital of €1, registered under SIRET number 109 510 941 00015, whose registered office is at 49A rue de la Balue, 35400 Saint-Malo, France, represented by Océane André, President ("Agostina", "we"). Contact: contact@agostina.store.
Agostina connects independent creators (unique pieces, made-to-order pieces, small collections) with buyers through a mobile app.
These Terms of Use ("Terms") apply to anyone using Agostina. They consist of:
- Title I (rules common to all users);
- Title II (conditions applicable to purchases);
- Title III (reference to the Seller Terms, which apply to creators in addition).
They are supplemented by the Privacy Policy. By creating an account, you accept these documents.
Article 2 — Account
You must be an adult (18 years old or over). You provide a valid email address and a password, and undertake to give accurate information and keep it up to date. An account is personal and only one account per person is allowed. You are responsible for keeping your login details confidential and for the activity of your account. In case of unauthorised access or suspicion of it, you must tell us without delay at contact@agostina.store.
Article 3 — Agostina's role and transparency
Intermediary. Agostina is a technical intermediary: the sales contract is concluded directly between the creator and the buyer. Agostina is not the seller of the pieces. It provides the app, secure payment and the organisation of shipping, and may help the parties communicate in case of difficulty (Articles 11 to 13), without becoming a party to the sale.
Seller status. Each creator declares accurately whether they sell as a professional or a non-professional and provides the information and supporting documents requested by Agostina and by regulations. This status is shown on the shop page and on every product page before purchase.
Professional status is assessed under the applicable legal criteria (in particular the habitual and profit-making nature of the activity) and does not result from the creator's declaration on the platform alone. Agostina may ask for additional information, reclassify a shop and suspend the listing of its products if information is missing, inaccurate or inconsistent.
Agostina's remuneration. Agostina receives from the creator a commission on the price of each piece sold, excluding delivery costs (17% by default; the rate applicable to each shop is communicated to it). The buyer pays the price of the piece and the delivery costs, with no additional service fees.
Presentation of content. The content of the feed and the search is organised as follows. Home: the pieces of active shops, from newest to oldest; the filters you choose (category, sale mode, shop country, material) narrow the list without changing its order. Shop search: the text you enter is matched against the shop's name, description or city, and results are sorted alphabetically by name. This ranking is not personalised: it depends neither on your history, nor on your likes, nor on your location. Shops you have blocked are hidden. No shop can buy a better ranking or a promotion.
Article 4 — Published content and intellectual property
Users keep all their rights over the content they publish (photos, videos, texts, creations). They grant Agostina a non-exclusive, royalty-free, worldwide licence, for as long as the content is on Agostina, to host it, reproduce it, adapt it to the app's format and display it in the app and on the agostina.store website. Any other use (for example on Agostina's social networks) requires the prior agreement of the person concerned. This licence ends when the content or the account is deleted, subject to the technical time needed.
Any user who publishes content guarantees that they hold the necessary rights (including over music, images and the people shown) and that the content infringes no third-party right.
The following are prohibited: counterfeits, illegal, hateful, violent, misleading or sexually explicit content, and any piece whose sale is illegal.
The app, the Agostina brand and its visual identity remain Agostina's property.
Article 5 — Reporting and moderation
Any user can report a product, a video or a shop from the app, and block a shop. Reports are reviewed by a member of our team. Agostina's moderation relies on manual approval of shops and human monitoring of reports; it is not an exhaustive automated check of all content.
When we remove content or suspend an account, we inform the person concerned and give the reason, unless the law requires otherwise. They can challenge the decision by writing to contact@agostina.store; their request is reviewed by a member of the team. This address is also our single point of contact for authorities and for users.
Article 6 — Suspension, termination and account deletion
Agostina may suspend or delete an account in case of breach of the Terms, fraud or a confirmed report. The rules specific to creators (notice, orders in progress) are in the Seller Terms.
You can ask to delete your account at any time from the app (Profile, ⚙, "Paramètres" (Settings), "Zone de danger" (Danger zone), "Supprimer mon compte" (Delete my account)) or via the page agostina.store/delete-account. For a creator, deletion is refused while an order or a payout of their shop is in progress; it can be requested again as soon as these obligations have been fulfilled. Your personal data is then deleted or anonymised, except what we must keep (orders, billing, disputes) under the Privacy Policy.
Article 7 — Notifications
You can allow notifications in your device settings. They concern your activity on Agostina (orders, shipments, payouts and, if you turn on the bell on a shop's page, news from that shop). You can turn them off at any time in your device settings.
Article 8 — Personal data
The processing of your personal data is described in the Privacy Policy.
TITLE II — PURCHASES
Article 9 — Orders, prices and delivery area
Prices are shown in euros, including all taxes when the seller is subject to VAT. When the seller is not, VAT is not applicable and the price shown is the price to pay. Delivery costs are calculated separately at payment, shop by shop. In a multi-shop order, if delivery cannot be calculated for one of the shops, the entire payment is cancelled and you are not charged.
The order is concluded once payment is validated. A unique piece is allocated to the first buyer whose payment is validated. For a made-to-order piece, the production time announced by the creator is added to the shipping time.
Delivery is currently limited to France. Opening other countries will lead to an update of these Terms.
Before you confirm your order, you have the following information on the product page and at payment: the characteristics of the piece, its price, delivery costs and times, the identity of the seller and their status (professional or not), and the return conditions and their costs.
Article 10 — Payment
Payment is collected by Agostina, on behalf of the seller, through Stripe, a payment service provider. Agostina has no access to your card number. In case of proven fraud or non-payment, Agostina may cancel an order and suspend an account. If payment fails, the order is not concluded.
Article 11 — Delivery and incidents
The creator prepares the parcel and buys the shipping label through Agostina. As soon as the carrier takes charge of the parcel, the buyer receives tracking. If the creator does not deliver within the agreed time, or, if no date was agreed, within a maximum of 30 days from the order, the buyer may, after formal notice, terminate the sale under the conditions set by the Consumer Code.
Delivery incidents. In case of delay, loss, damage or non-receipt of an order, the buyer is invited to contact Agostina at contact@agostina.store to help the handling of their claim. Agostina may act as an intermediary between the buyer, the creator and the carrier. These arrangements apply without prejudice to the buyer's legal rights and the creator's obligations as seller.
Article 12 — Right of withdrawal (sales by a professional seller)
This article applies when the seller is a professional and the buyer is a consumer.
Period. You may withdraw without giving any reason within 14 days of receiving the piece.
How to withdraw. You may, as you choose:
- use the "Renoncer au contrat ici" ("Withdraw from the contract here") function available in the app, from the details of the order concerned, then confirm your withdrawal with the button provided. You receive an acknowledgement of receipt on a durable medium (email);
- send the model form in the appendix, or any unambiguous statement, to contact@agostina.store.
The function is free, available throughout the whole period, and its location is indicated before the order.
Returning the piece. You send the piece back no later than 14 days after your withdrawal. Return costs are at your expense in case of withdrawal; this information is repeated on the product page and at payment, before your purchase. The choice of carrier and shipping method for the return is yours, and the piece travels at your risk until the creator receives it: we recommend a tracked shipment.
Refund. It covers the price of the piece and the initial delivery costs (standard delivery). It is made no later than 14 days after the withdrawal, using the same means of payment; it may be deferred until the piece is received or proof of its shipment is provided. The piece must be returned in good condition; a loss of value caused by excessive handling may be deducted.
Exceptions. The right of withdrawal does not apply to pieces made to your specifications or clearly personalised (for example made to measure or made according to your particular requests). A piece that is simply "made to order" from a shop's model, without personalisation by you, remains subject to the right of withdrawal. The "personalised" indication appears on the product page before purchase.
Article 13 — Guarantees and non-conforming pieces
This article applies when the seller is a professional and the buyer is a consumer. It is separate from withdrawal: "change of mind" (Article 12) and a defective or non-conforming piece do not follow the same rules.
You benefit from the legal guarantee of conformity (2 years from delivery) and the guarantee against hidden defects. If the piece you receive is defective or does not match its description, contact the creator or contact@agostina.store: you may obtain its repair, replacement, a price reduction or a refund as provided by law. The cost of returning a non-conforming piece is borne by the seller.
Article 14 — Sales by a non-professional seller
When the seller is a non-professional, the sale is not subject to the 14-day right of withdrawal or to the legal guarantee of conformity of the Consumer Code. The buyer remains protected by ordinary law (in particular the obligation to deliver a piece that matches its description, and the guarantee against hidden defects) and can contact Agostina in case of a problem.
Agostina also applies the following rules as a commercial gesture, which is not a legal right of withdrawal:
- Non-delivery. If the piece is never delivered or is lost, you are refunded in full (price of the piece and delivery costs).
- 14-day return. You may send the piece back within 14 days of receiving it, without giving any reason, under the arrangements of Article 12: return costs at your expense, piece returned in good condition, refund of the price of the piece and the initial delivery costs. Pieces made to your specifications or clearly personalised are excluded.
This status is shown before purchase (Article 3).
Article 15 — Consumer mediation
In case of an unresolved dispute with the seller (if professional) or with Agostina, you can use, free of charge, the consumer mediator: The mediator's details will be shown here before sales open.
TITLE III — CREATORS
Article 16 — Becoming a creator
Every application is reviewed and manually approved by our team, which may accept or refuse it. The creator acts fully independently; they are neither an employee nor an agent of Agostina. Opening a shop is subject to acceptance of the Seller Terms, which govern in particular commission, payouts, refunds, disputes and the end of the relationship.
TITLE IV — FINAL PROVISIONS
Article 17 — Liability
Agostina endeavours to keep the app running properly without guaranteeing continuous availability, and is not liable for interruptions beyond its control or force majeure events. Creators are solely responsible for their creations, their compliance, their content and the performance of their sales. Nothing in these Terms limits the rights that the law gives to consumers, or Agostina's liability where the law forbids such a limit.
Article 18 — Changes to the Terms
We may change the Terms. Any substantial change is announced in the app at least 15 days before it takes effect; this notice applies in any case to creators. If you refuse it, you can delete your account before that date; continuing to use Agostina afterwards means acceptance. Orders already placed remain governed by the Terms applicable at the time of the order.
Article 19 — Governing law and disputes
The Terms are governed by French law. In case of a dispute, you can first write to us at contact@agostina.store and then, for consumers, use mediation (Article 15). Failing agreement, the competent courts are determined under the legal rules; consumers keep the option of bringing the case before the court of their home.
